Some Basics to avoid
unnecessary e-Mails:
- In the interest of a smooth transaction the eMail address you stored
with ebay has to be
working and your postal address should agree with the delivery address.
- WE will contact the winnig bidder within three working days
beginning with the end of auction. Please do NOT send a "where do
I have to transfer the money to" mail on the same day.
- In case the winning bidder does not hear from us within three days,
there must be a problem with his/her mailbox. Please make sure it is
not overloaded and have a look in your Spam file. Only if it still
doesn't work

- After having read the Dispatch

within the normal running time of a parcel.

be reasonably invested into a faster and more effective processing,
wich would help everybody

Shipping costs
Germany
We exclusively ship by insured
parcel. For the shipping of parcels within Germany we charge the "shipping
flat rate" quoted in the auction. Payments have to be made in
advance via money transfer.
Shipping costs can be found at
the bottom of the item page in the space provided for by ebay.
In the case you purchase more
than one item from different auctions or several fixed-price items the
additional flat rate for any further item is 2,- Euro, provided that
shipping can be managed in one collective parcel.
(The decision what fits in
one parcel or not has to be up to us. For the people who think you could
fit a whole car in one parcel: IT DOESN'T !)
Should somehow the "shipping
flat rate" not be quoted in the auction please inform yourself
PRIOR to bidding. Just send us an eMail including the
item-number and ask for the corresponding shipping conditions. - Once a
bid has been placed and the auction is finalised shipping costs are NOT a
subject to bargaining!
Because in the past many of
our customers did not approve of our shipping-costs, although they had
been quoted in the auction and therefore been accepted with the placement
of a bid, we offer you this information: In 95 % of all cases we have
to use new cartonage for shipping. Our purchase costs are varying between 0,60
and 8,00 € plus filling material and tape. In the resulting 5% the size
of the items enables us to recycle cartons used for "banana and
cucumber shipping". We reserve this right for reasons of
environmental protection. In addition, our employees (those who do the
packing) would like to get their pay check on the 1st of every month.
Should anybody not be comfortable with this procedure, we would ask you
not to bid on our items.
Items that have been described
as "pickup only" or "reiner Abholartikel" HAVE to be
collected within 8 days. Should this not be possible we would ask you
to pay in advance using money transfer.
Naturally it is possible to
"pick up" items bought from us, however Collection
is only possible with a confirmed appointment within 8 days of the
end of auction
Please don't forget to
state an exact time together with your target date.
Statements such as a.m or p.m as well as tomorrow or
next week do not count as time or date consistently. Therefore they
will not be accepted

We do not have
OPENING HOURS. Don't be dissappointed
if you arrive without appointment and we are closed!

Folks,
please do not make the effort of trying to reach us through telefone
numbers other than the one above. What you get from the telefone book does
not represent the state of time and is just there because the network
doesn't manage to delete it.
On collection a one
time handling fee of 3,- Euros has to be payed no matter how many
items you buy.The latter does not apply to "pickup
only" or "reiner Abholartikel" items.
If you pick up your item
without confirmed appointment or missing printout of the confirmation we
will charge you 5,- Euro for unnecessery efforts you cause us!
We store "pick
up" items that have allready been cleared for a maximum of 100 days.
Thereafter storage is going to be charged with 1% of the item value per
day. In addition the item will be re-placed with ebay and sold. This also
applies to parcels that can't be delivered because you gave us the wrong
address or similar reasons
In this case we
do NOT refund.
Should anybody
not want his item delivered by parcel service and insist on
shipping by post we will have to charge an additional 5,- Euro in
extra handling.
To your information: shipping through post is limited to a maximum of 20
kilos.
The adequate parcel
service will be selected by us based on our experiences.
Pricipally we only
deliver through our own parcel services or dispatcher and offer you a
personal pick up.
Due to technical
difficulties Pick-up of your item through your own parcel service is NOT
possible.
Should the customer
not be met by the parcel service or the dispatcher, we will be forced to
subsequently claim any additional costs this causes us from the customer.
This will amount to at least 30.- Euros, that, should it become necessary, we
will claim through our lawyer.
Shipping
costs Oversea
Principally we offer
Oversea shipping. However shipping as well as international money transfer
costs are more expensive. As an alternaitve to international
transfers, at present we can only offer you to ship the money per mail (
i.e. certified mail or similar). (It is much cheaper and in most cases
also faster)
Due to the
high fees we do not accept payment through Paypal or Credit card.
Costs for Oversea
shipping are based on weight and vary from case to case. Therefore we can
not offer a fixed rate shipping.
As a general
rule you can assess shipping costs for Europe with double the price of
national shipping.
Because of Custom
regulations shipping into Switzerland has to be charged with an additional
5,- Euro.
Minimum cost for
oversea shipping is 20,- Euro (Austria 15,- Euro / Switzerland 25,- Euro)
Please inform yourself
about our shipping conditions PRIOR to
bidding. Just send us an eMail including the
item-number and ask for the corresponding shipping conditions. - Once a
bid has been placed shipping costs are NOT a subject to bargaining!
Payment and
Shipping
We only ship with
advance payment and offer you a personal pick up with
confirmed appointment.
Because an increasing number of people has developed a
habit of not accepting "cash on delivery" parcels. We will NOT
offer this method of payment any longer

To be precise:
NO item whatsoever will leave our storage before having been fully paid
for!
Apologies to all the
honest customers but there is no other way to make it work - say thanks to
the black sheep!
Delivery
times and other deadlines
- stock goods and used parts will be dispatched within 2 working days
after receipt of payment
- Due to the complexity of packing bulky parts, the dispatch of those
can take uo to 5 days.
- Items offered as new, especially fixed-price items are normally in
stock and count as stock goods.
- In the case of overwhelming demand or special parts that are not
stocked in great numbers, especially air filters, it can happen that
the item is not immediatley available.
- For Items that are not in stock we will arrange an omnibus order on
mondays and they will be delivered as soon as they are available. In
98% of all cases this means they will be delivered within one week
after the order reaches our contractor.
- We shall not be liable for delays due to delivery problems of the
contractor.
- No dispatchment on saturday.
- Credit and Complaints are only handled on weekends as there is
no dispatch.
- Because of our automated system, on day 10 after the end of auction
without receipt of money exactly ONE monition will be sent.
- Another 10 days without receipt of money and the ebay-provision will
be credited back and the item will be re-auctioned. If payment is late
you LOOSE your right of delivery, should the item have been
resold allready
Auction
conditions and additional Info regarding shipping and handling
- As soon as the Auction is finished you will receive an automatically
generated eMail with a link to our processing site which was generated
especially for you.
For reasons of security this site is encrypted
and only accesible for you and us.
Processing does exclusively work through this site, where you will
have to provide your telefone number and make shipping arrangements.
Please do NOT use the "after buy processing" provided by ebay
- Your telefone number will only be
used for queries concerning shipping.
This
helps avoiding unnecessary long shipping times. So it is in your own
interest that you enter a properly working telefone number. We do
not do telefone advertising and do not give contact details away to
third persons.
- In case the winning bidder does not hear from us within three days,
there must be a problem with his/her mailbox. Please make sure it is
not overloaded and have a look in your Spam file.
- Because of repetitive auctions the
illustrations, if not told otherwise, can vary.
- Concerning spare parts that are offered in connection with the
official spare part number, the latter has to be compared
PRIOR TO BIDDING. We are not going
to take Items back that you ordered wrong.
- Spare part numbers merely serve for the purpose of orientation and
do not guarantee that the parts can actually be used in the
corresponding car. It is therefore NON-BINDING
We reserve the
right, to supply other parts which are identical in construction as
well as fitting accuracy.
- Until completion of payment the Item is our property.
- With the placement of a bid in one of our auctions you accept the Au
ction conditions
published on our -Page
which apply from thereon.
- AFTER an auction has ended NEITHER the item-price and shipping costs
NOR the condition of the item are subject to discussion.
- For reasons of German fiscal law spare parts are sold with invoice
and accounted VAT. This is no warranty that you are buying new parts.
NEW is only what we advertise as NEW in our auctions.
- Anybody bidding on used parts anticipating new parts for a few Euros
is wrong. Rather save our time, drive to your nearest BMW dealer and
order new parts at corresponding prices.
- Included in delivery of used parts is only what we promise in the
description.
If accessories belong to an Item it is mentioned in
the description. (i. e.: ... with connecting lead)
- NO TEXT - NO
ACCESSORIES (Exaggeration makes it obvious:
Allthough we don't write "Tires without Car" the Car is not
included in the delivery of the tires!)
- Possible reconsignments of items have to happen prepaid in the
original state and packaging, mail which is not prepaid or is declared
"cash on delivery" will not be accepted.
- Credit will only happen AFTER successful reconsignement, after we
have tested the Item,with un
damaged
seals or plumbs and
after deducktion of our costs. (this is obviously not the case when we
approve of your reclamation)
- Mailing expenses are
principally
NOT refunded.
- Credit will only happen for the purpose of charging with other
purchases.
A refund of the purchase price is not possible.
- In the case of an eventual case concerning guarantee or warrantee,
the warrantee is limited to the pure product. Any other responsability,
especially concerning assembly-, alteration- and failure cost as
well as consequential damage is EXCLUDED.
- If an item is blamed as broken, and after testing it appears that
this blame was unjustified, the sender accepts the charge of an
allowance of 30,- Euro. The sum is payable within 10 days prior to us
returning the item. Should the sender not meet this deadline we will
charge a flat rate of 5,- Euro per commenced week for storing purposes.
Should the amounting sum exeed the current market value of the item,
the latter becomes the property of the seller.
- Concerning used parts which are offered as fully functual this is
related to the sole item.
Accus, Batteries as well as other
expendable parts or items are not related to the functuality and
therefore cannot be a reason for a customer complaint.
- Items sold as "broken" "damaged" "battered"
or "not tested" ("defekt"
"beschädigt" "abgenutzt" "nicht
getestet" ) or with a similar attribute
CANNOT
in any case be returned. Broken is broken. We do not discuss whether
an item is more or less broken
- Likewise, items offered with the comment "state as pictured"
("Zustand wie abgebildet")"
CANNOT
be taken back if the buyer has not made an enquiery to the actual state
the item is in.
- We shall not be liable for mistakes of our suppliers and parcel
services such as: shortfalls, delayed delifery or transportation
damages.
- After having made several bad experiences we can only guarantee the
functuality of used parts if those are tested during pick up or
concerning shipping
if
all Seals and Plubs are immaculate.
- It is categorically
impossible to take back items where seals or plumbsare are missin or have
been damaged.
This
is also valid for items where a removal of the
seals or plumbs has been attempted.
- Should items with damaged seals or plubs be sent back in disregard
of what has previously been said, it will be the choice of the
customer whether we see to their free disposal or charge him with the
costs of returning them to him.
- Concerning used items such as parts of the body or equipment
components it is impossible to count every scratch, dent or rusty
patches. Please ask for Information concerning the condition of those
parts

BIDDING.

- Because it is difficult to maintain a clear overview over all the
feedback, we will write your feedback IMMEDIATLEY after we have
received yours.
- We do not tolerate, Feedback where you hold forth about
aforementioned and through bidding accepted shipping conditions.
- As people have not appreciated our fair dealing in the past, as of
now we will NOT negotiate our shipping conditions.
- With regard to your item the
shipping
conditions valid
on the closing
day of the auction apply.
- Through placing a bid
you conclude a valid contract of purchase without a right of
withrawal .
- We politely ask you to
only bid on items that your are able to pay for.
- Used items are sold without warranty and without a right of
withdrawal.
Hereby we formally announce the exclusion of the
yearlong warranty for used items according to new EU-Law.
- If you return delivered but not assembled items, we will charge a re-storage
fee of 20%.
- Any additional costs incurred by the seller, i.e. higher re-storage charges
of our supplier, wil be debited to you.
- This does not mean that we guarantee the possibility of returning items and
cancelling orders.
- For the reversal of a completed auction we will charge 20% of
the item value however at least 5,- Euro. In case of need we will see
to this through our lawyer.
- If payment is late and we resold the item after refund of the
provision, we will count it as reversal.
In this case the purchase
price will be refunded with a deduction of the obove mentioned charges
- All non-paying bidders are charged with the ebay
fees and the costs for a written warning in addition to the above
mentioned 20% of reversal charges.
- We will only tolerate serious bids. If you don't comply with this
rule we will forward your bid to ebay and give
you a bad feedback.
Other claims for damages will stay unaffected.

A private consumer with permanent residence in Germany has a right
of withdrawal in connection with contracts accomplished through
distance selling. According to this law he has the possibility to
revoke a contract without having to give any reasons within two weeks
of the arrival of his item. The
revocation can happen through writing or reconsignment of the goods to: Mick’s Car

Please indicate the shippment clearly as "REVOCATION" and enclose
your account information written onto the original invoice in order for us to
re-transfer your money.
Should the original invoice not be included, it can happen that the sales tax
will not be reimbursed. See: § 14c
UStG.
Important: The costs for shipping will only be compensated to the
amount of the cheapest mode of dispatch according to the rates of the Deutsche
Post AG. Please inform yourself about the costs that will result for you. Please
see to a tidy packing for shipment and keep in mind that we will categorically
neglect the acceptance of shipments that haven't been prepaid. When executing
the right of withdrawal the customer will bear the costs for returning goods
which are not valued in exceed of 40,- Euro. Depreciation due to usage for the
intended pupose has to be comensated by the customer, except when the
depreciation can be attributed to legitimate testing of the goods. Depreciations
can be avoided through careful handling as well as having components installed
by qualified and authorised staff. The right of revocation expires for: goods
that have been unsealed by the customer, allready opened consumables as well as
items that have been custom-tailored. A right of revocation does not exsist if
the transaction has been concluded for reasons that serve the commercial pratice
or self-employment of the customer. This does also apply if the customer (justified
or unjustified) bids in an auction that has been reserved and identified (B2B)
as an auction exclusively for re-sellers and free-lance traders. For the
purpose of rescission of the contract we will only take back items in their
original packing together with complete accessories. Anything that was delivered
has to be returned. The deterioration of original packing and traces of usage
will lead to a decrease in value.
If the customer is not able to replace benefits/items or only in a
depreciated state, he can be obligated for value replacement.
